Policy

We respect your privacy and are committed to protecting it through our compliance with this privacy policy ("Policy"). This Policy describes the types of information we may collect from you or that you may provide on the www.displaysbyibo.com website ("Website" or "Service") and related products and services (collectively, "Services"), and our practices for collecting, using, maintaining, protecting, and disclosing that personal information. It also describes your choices regarding our use of personal information and how you can access and update it.

This Policy is a legally binding agreement between you ("User", "you" or "your") and IBO Associates MidWest LLC, doing business as Displays By IBO ("Displays By IBO", "we", "us" or "our"). If you enter into this Policy on behalf of a business or other legal entity, you represent that you have authority to bind that entity. If you do not have such authority, or do not agree with this Policy, you must not accept it and may not access or use the Website and Services.

By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by this Policy. This Policy does not apply to companies we do not own or control or to individuals we do not employ or manage.

Collection of personal information

You can access and use the Website and Services without telling us who you are or revealing information that identifies you as a specific individual. If you wish to use certain features, however, you may be asked to provide personal information, such as your name and email address.

We receive and store information you knowingly provide when you make a purchase or fill out forms on the Website. You may choose not to provide personal information, but you may then be unable to use some Website features. Users who are uncertain about what information is mandatory are welcome to contact us.

Privacy of children

We do not knowingly collect personal information from children under age 18. If you are under 18, please do not submit personal information through the Website and Services. If you believe a child under 18 has provided personal information through the Website and Services, contact us to request its deletion.

We encourage parents and legal guardians to monitor children's Internet use and to instruct children never to provide personal information through the Website and Services without permission.

Use and processing of collected information

We act as a data controller and a data processor when handling personal information unless we have entered into a data-processing agreement with you under which you are the data controller and we are the data processor. Our role may differ depending on the situation.

We act as a data controller when we ask you to submit personal information necessary for access to and use of the Website and Services because we determine the purposes and means of processing. We act as a data processor when you submit personal information through the Website and Services and we process it only according to your instructions.

To make the Website and Services available or meet a legal obligation, we may need to collect and use certain personal information. If you do not provide requested information, we may be unable to provide requested products or services. Information we collect may be used to:

  • Fulfill and manage orders.
  • Deliver products or services.
  • Respond to inquiries and provide support.
  • Run and operate the Website and Services.

Processing depends on how you interact with the Website and Services, where you are located, and the applicable legal basis, which may include consent, performance of a contract or pre-contractual obligations, compliance with a legal obligation, a task carried out in the public interest, or legitimate interests pursued by us or a third party.

Under some laws, we may be allowed to process information until you object without relying on consent or another legal basis. We will clarify the specific legal basis that applies upon request, including whether providing information is a statutory or contractual requirement or necessary to enter into a contract.

Payment processing

For Services requiring payment, you may need to provide credit-card details or other payment-account information, which will be used solely to process payments. We use third-party payment processors ("Payment Processors") to assist with secure payment processing.

Payment Processors adhere to security standards managed by the PCI Security Standards Council. Sensitive and private data exchanges occur over SSL-secured communication channels and are encrypted and protected with digital signatures. We share payment data with Payment Processors only as necessary to process or refund payments and address related complaints and inquiries.

Payment Processors may collect personal information, such as your email address, mailing address, credit-card details, and bank-account number, and handle payment steps through their own systems. Their use of personal information is governed by their privacy policies, which we encourage you to review.

Disclosure of information

Depending on requested Services or as necessary to complete a transaction, we may share information with affiliates, contracted companies, and service providers (collectively, "Service Providers") that assist in operating the Website and Services and whose privacy policies are consistent with ours or who agree to abide by our policies concerning personal information. We do not share personally identifiable information with unaffiliated third parties except as described in this Policy or required or permitted by law.

Service Providers are not authorized to use or disclose your information except as necessary to perform services for us or comply with legal requirements. They receive only the information needed for their designated functions, and we do not authorize its use for their own marketing or other purposes.

We may disclose personal information if required or permitted by law, such as to comply with a subpoena or similar legal process, or when we believe in good faith that disclosure is necessary to protect rights or safety, investigate fraud, or respond to a government request.

Retention of information

We retain and use personal information for the period necessary to comply with legal obligations, enforce this Policy, and resolve disputes, unless a longer period is required or permitted by law.

We may use aggregated data derived from or incorporating personal information after you update or delete it, but not in a way that identifies you personally. Once a retention period expires, personal information shall be deleted. Rights of access, erasure, rectification, and data portability cannot be enforced after expiration of the retention period.

California privacy rights

California consumers have additional rights concerning personal information under the California Consumer Privacy Act ("CCPA"). If you are a California resident, this section applies to you.

California residents who provide personal information, as defined by statute, to obtain Services for personal, family, or household use may request and obtain, once per calendar year, information about the categories and specific pieces of personal information we collected and disclosed.

California residents may also request deletion of personal information or opt out of its sale, which may include selling, disclosing, or transferring personal information to another business or third party for monetary or other valuable consideration. Contact us to make such a request. We will not discriminate against you for exercising rights under the CCPA.

How to exercise your rights

Requests to exercise your rights may be directed to us using the contact information below. We may ask you to verify your identity before responding. Your request must provide sufficient information to verify that you are the person you claim to be or an authorized representative. If an authorized representative submits the request, we may seek evidence of a power of attorney or other valid written authority.

You must include enough detail for us to understand and respond to the request. We cannot respond or provide personal information unless we verify your identity or authority and confirm that the personal information relates to you.

Do Not Track signals

Some browsers include a Do Not Track feature that signals to websites that you do not want your online activity tracked. Tracking is different from collecting information in connection with a website; for this purpose, it refers to collecting personally identifiable information as users move across different websites over time.

Browser communication of Do Not Track signals is not uniform. As a result, the Website and Services are not currently set up to interpret or respond to those signals. Even so, as explained in this Policy, we limit our use and collection of personal information.

Links to other resources

The Website and Services may contain links to resources we do not own or control. We are not responsible for the privacy practices of those resources or third parties. When you leave our Website, we encourage you to read the privacy statement of each resource that may collect personal information.

Information security

We secure information you provide on computer servers in a controlled, secure environment protected from unauthorized access, use, or disclosure. We maintain reasonable administrative, technical, and physical safeguards to protect personal information in our control and custody. However, no data transmission over the Internet or a wireless network can be guaranteed.

While we strive to protect personal information, you acknowledge that the Internet has security and privacy limitations beyond our control; the security, integrity, and privacy of information exchanged between you and the Website and Services cannot be guaranteed; and information may be viewed or tampered with in transit by a third party despite best efforts.

Because security also depends on the device you use and how you protect your credentials, please take appropriate measures to safeguard this information.

Data breach

If we become aware that the security of the Website and Services has been compromised or that users' personal information has been disclosed to unrelated third parties through external activity, including security attacks or fraud, we reserve the right to take reasonably appropriate measures, including investigation, reporting, notification, and cooperation with law-enforcement authorities.

We will make reasonable efforts to notify affected individuals when we believe there is a reasonable risk of harm or when notice is otherwise required by law. When we do, we will send an email.

Changes and amendments

We reserve the right to modify this Policy or its terms related to the Website and Services at any time. When we do, we will revise the updated date on this page and post a notification on the main page of the Website. We may also provide notice in other ways, including through contact information you have provided.

An updated version will be effective immediately upon posting unless otherwise specified. Continued use of the Website and Services after the effective date constitutes consent to the changes. Without your consent, however, we will not use personal information in a way materially different from what was stated when it was collected.

Acceptance of this policy

You acknowledge that you have read this Policy and agree to its terms and conditions. By accessing and using the Website and Services and submitting information, you agree to be bound by this Policy. If you do not agree, you are not authorized to access or use the Website and Services.
